BUG COMMANDER SERVICE AGREEMENT AND LIABILITY RELEASE (V2.26)

A signed Service Agreement is required to be on file before Bug Commander (hereby referred to as BC) will schedule or perform any services. This property-specific agreement is designed to lend transparency to BC policies so that both parties understand the expectation of each party, therefore it does not include service-specific details or pricing. This agreement will commence on the date signed and will continue for an indefinite term, unless and until terminated by either party.

Clients are entitled to terminate services at any time. Cancellation requests can be made via email, text, or phone call. Clients may receive an additional invoice if a package is not fulfilled. Any outstanding invoices will be subject to BC billing policies.

BC is entitled to terminate an account for not complying with this service agreement. Inappropriate or rude behavior toward any staff of BC will result in account termination (this includes behavior from anyone who contacts BC on behalf of an account holder.) If an account is terminated, notice will be given via email and/or mail.

PRIVACY POLICY

BC is the sole owner of the information collected to service your account. BC will take necessary precautions to protect your information online and offline through the use of secure capture methods and procedures. Sensitive information, such as credit card numbers or bank accounts, will be collected and transmitted to BC through secure means only. Employees that need to access client information to perform an administrative task or access a client’s property to perform a service will do so under discretion.

SCHEDULING

Technicians: BC technicians are licensed to perform certain services. Because of this, some services cannot be completed at the same time or on the same day as other services.

Service Dates: All service dates for exterior treatments are tentative and will be automatically modified as needed pending weather conditions and route optimization. No additional emails, texts, or phone calls will go out to indicate that the schedule has been modified. Because of the many variables in the services BC provides, routes are scheduled to accommodate technician availability. Requests for specific days or times cannot be guaranteed.

Rescheduling: BC will reschedule interior services if there is a conflict with route optimization or technician availability. Clients will be notified of the need for a change in service date. If a property is not appropriately accessible to BC technicians on the agreed date and time for an exclusion service, BC will require a non-refundable deposit of 50% of the treatment price before the service will be rescheduled. This deposit will be applied to the scheduled exclusion service only.

Pets: If a BC technician is unable to service a property due to a pet being in the way or acting aggressively, the service will be skipped. The service will be rescheduled to accommodate technician availability. BC has the right to terminate services and/or the account if there is a second instance of a pet being in the way or acting aggressively.

Mosquito Control Services: Mosquito treatments will not be performed out of season. A minimum of three weeks notice is required for mosquito control services to get on BC’s schedule for a major holiday (Memorial Day weekend, 4th of July, Labor Day weekend) or special event (grad party, wedding, family gathering, holidays, etc.).

WARRANTIES OF SERVICES

All warranties are subject to and determined by the BC technician performing the service and warranties apply to livable structures only. Clients will be notified by the BC technician or office if their property is unable to receive a warranty. If a BC technician is denied the ability to treat all areas of a property (by either an owner, renter, service provider, or guest) that is deemed necessary for control, the warranty on that treatment will automatically become void.

Requesting a Warranty: Warranty requests can be made via email, text, or phone call (including voicemail). BC will work to get warranty treatments on the schedule within a week of notification. Any warranty requests made after the warranty request deadline will not be scheduled.

Weather: BC closely monitors weather conditions to evaluate optimal treatment times for any service. If a treatment is done in less than desirable conditions and the waiting period has passed to see if control is maintained, the client is entitled to exercise the warranty based on the service.

Security Cameras: Due to the broad sensitivity range of security cameras, footage or lack thereof of a BC technician’s appearance will not guarantee a warranty of service.

Use of Other Products: The use of home-made remedies and/or store bought pest control products may void BC treatment effectiveness and the subsequent warranty for that service.

Child Care Facilities/Schools: Warranties on BC services may be limited or void due to state and federal laws regarding pest control devices installed at these types of locations.

Mosquito Control Services: If 3 days after a treatment has passed and an 80% reduction in mosquito activity is not observed (compared to untreated areas), a warranty request must be made to BC within 10 calendar days of the service date.

Common Bug Exclusion Services: If 7 days after a treatment has passed and an 80% reduction in bug activity is not observed, a warranty request must be made to BC within 90 calendar days of the service date.

Bedbug, Cockroach, Flea, Foreign Grain Beetle, Clothes Moths, Pantry Pests, & Termite Control Services: These services require a minimum number of treatments to be considered for warranty. Warranty will depend on the type of pest, the type of infestation, and be based on the completion of client responsibilities as listed in an email prior to service and in the invoice after service. Warranty requests must be made to BC within 90 calendar days of the follow-up treatment service date.

Common Rodent Exclusion Services: Warranty will depend on the type of infestation and be based on completion of client responsibilities as listed in an email prior to service and in the invoice after service. Warranty requests must be made to BC within 120 calendar days of the service date.

Rat Exclusion Services: This service requires a minimum of 3 treatments to be considered for warranty. Warranty requests must be made to BC within 120 calendar days of the follow-up treatment service date.

Stinging Pest Exclusion Services: Warranty requests will only apply to treated nests (not new nests) and must be made to BC within 90 calendar days of the service date.

Structural Bug Prevention Services: Warranty requests will apply as long as there is not a current common bug infestation inside of the treated structure prior to service and must be made to BC within 60 calendar days of the service date. Denial of BC to treat windows and/or frames will result in a voided warranty.

Structural Fall Invaders Treatment:  Warranty requests will apply as long as there is not a current common bug or common rodent infestation inside of the treated structure prior to service and must be made to BC within 90 calendar days of the service date. Warranty does not cover any new stinging pest nests that develop after the treatment and denial of BC to treat windows and/or frames will result in a voided warranty.

Pro Bugs Package: Warranty treatments will be performed if any common bugs get inside of the treated structure. This includes stinging pest nests on the interior or exterior of the treated structure. Warranty does not apply to the landscaping, foliage, or yard around the treated structure. Denial of BC to treat windows and/or frames will result in a voided warranty.
